Hire a real estate attorney who shows up
Real-estate transactions can be routine for an experienced attorney, but some of my colleagues take this too far: they allow a paralegal to handle each and every step without becoming involved.
An experienced paralegal is valuable, but there is an expectation that when an attorney is hired for a certain fee, that the attorney is going to be familiar with that file. If your attorney isn’t present for the closing, or is in the building but not in the room, that’s a sign that this is an attorney who is trying to maximize profit by not spending time on the work that you paid that attorney to oversee.
Not every step in the the process needs to be performed by an attorney, but that attorney should be familiar with the issues involved. When you’re looking for a real estate attorney, consider asking these questions:
How often will you review this file?
Who will go over the terms of the contract with me?
At what points does an attorney become directly involved?
How easy will it be to speak with you directly?
Which attorney will be present at the closing to answer my questions?
